Late Payment Policy
Late Payment Policy
Mad About Cleaning LTD
At Mad About Cleaning LTD, we are committed to delivering a professional, reliable cleaning service to both domestic and commercial customers throughout the UK.
To maintain the quality of our services and ensure the smooth running of our business, all customers are required to comply with the payment terms agreed at the time of booking or commencement of service.
This policy explains our approach to late payments, overdue invoices, interest and debt-recovery charges.
1. Domestic Cleaning Customers
Payment Terms
All domestic cleaning customers are required to pay for their cleaning service on the day the service is provided, unless an alternative arrangement has been expressly agreed in writing by Mad About Cleaning LTD.
Late Payments
Where payment is not received on the agreed date, the account will be considered overdue.
We reserve the right to contact the customer to request immediate payment and to take reasonable steps to recover any outstanding balance.
Where expressly agreed in our applicable customer terms and conditions, a reasonable late-payment or administration charge may be applied, provided that the charge is lawful, fair and proportionate.
The Late Payment of Commercial Debts (Interest) Act 1998 does not generally apply to domestic cleaning services purchased by individual consumers. Any charges relating to domestic customers will therefore be dealt with under the applicable contractual terms and consumer protection legislation.
Continued Non-Payment
Where a domestic customer repeatedly fails to pay on time, Mad About Cleaning LTD reserves the right, subject to the applicable agreement and reasonable notice where required, to suspend or discontinue future cleaning services until the outstanding balance has been settled.
We may also pursue unpaid debts through appropriate recovery procedures where necessary.
2. Commercial Cleaning Customers
Payment Terms
Unless otherwise agreed in writing, our commercial cleaning invoices are payable within 14 days of the invoice date (NET 14).
Customers are responsible for ensuring that payment reaches Mad About Cleaning LTD by the agreed due date.
If an invoice is disputed, the customer should notify us promptly, explain the reason for the dispute and pay any undisputed amount in accordance with the agreed payment terms.
Late Payment Interest
For qualifying commercial transactions, Mad About Cleaning LTD reserves the right to claim statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998, together with applicable amending legislation and regulations.
Statutory interest is generally calculated at 8% above the applicable Bank of England reference rate per annum, using simple interest, where the statutory entitlement applies and no qualifying alternative contractual remedy displaces it.
Interest may be calculated on the overdue qualifying debt from the applicable statutory start date until payment is received.
The precise entitlement and calculation will depend on the transaction, the agreed payment terms and the applicable legislation.
Fixed Compensation for Debt Recovery
Where statutory compensation is available for a qualifying late commercial payment, Mad About Cleaning LTD reserves the right to claim the applicable fixed sum in addition to statutory interest.
The statutory compensation amounts are:
- £40 for a qualifying debt of less than £1,000.
- £70 for a qualifying debt of £1,000 or more but less than £10,000.
- £100 for a qualifying debt of £10,000 or more.
These amounts are determined by the value of the qualifying debt and are generally claimable once for each qualifying late payment. They are not automatic charges on every overdue invoice regardless of the circumstances.
Where the applicable legislation permits, we may also seek recovery of reasonable additional debt-recovery costs that exceed the fixed compensation amount.
Recovery of Overdue Commercial Accounts
If payment is not received by the agreed due date, Mad About Cleaning LTD may contact the customer to request settlement and issue payment reminders or formal demands where appropriate.
For persistently overdue accounts, we reserve the right to pursue lawful debt-recovery procedures and, where permitted by the relevant agreement and law, suspend or terminate services in accordance with the applicable contractual provisions.
Any interest, compensation or recovery costs claimed will be limited to those permitted by the applicable law and contractual arrangements.
3. Payment Reminders and Communication
We aim to resolve payment issues professionally and fairly. Customers experiencing genuine payment difficulties are encouraged to contact us as soon as possible so that the matter can be discussed.
However, failure to receive a reminder or payment request does not automatically change an agreed payment deadline or remove any applicable statutory entitlement.
4. Scope of This Policy
This policy applies to domestic and commercial cleaning services provided by Mad About Cleaning LTD throughout the UK, subject to the relevant laws and regulations applicable to each transaction.
The Late Payment of Commercial Debts (Interest) Act 1998 and associated legislation apply to qualifying commercial debts, not automatically to all customers or all overdue payments.
Nothing in this policy is intended to exclude or restrict any statutory consumer rights or other legal protections that cannot lawfully be excluded.
This policy should be read alongside the relevant booking terms, customer agreement, payment terms and any other applicable contractual documents.
